Fairfield Man Arrested for Indecency with a Child

CROCKETT – A Fairfield man has been arrested and charged with one count of indecency with a child by sexual contact following his actions on April 6 of this year.

Jacinto Capuchin, 36, was taken into custody on Wednesday, Sept. 18 and charged with the second degree felony after he was picked up on a warrant for his arrest.

According to an affidavit of probable cause, the victim – identified as Jane Doe in the affidavit – was visiting a friend’s residence on the night of April 6. Capuchin was also at the residence.

“Jane Doe explained that all evening Jacinto was telling her to stay in school and get an education and later began complimenting her beauty, stating she looked like her mother.

Later that evening, Jane Doe informed officers with the Crockett Police Department, she was asleep in a bed when she felt someone sit at the foot of the bed.

“She stated she glanced up and saw Jacinto sitting towards the foot of the bed, but thought she was dreaming. According to Jane Doe, she then felt Jacinto’s hand slide up her leg and pull at the beltline of her pants, as if he was trying to pull them down,” the probable cause document stated.

Capuchin continued his actions as he groped Jane Doe’s genitalia and breasts, the affidavit indicated.  

“Jacinto then lifted Jane Doe’s head up and forced her to kiss him. She stated he pushed his tongue inside her mouth and she could taste the alcohol on his breath. At that time, she rolled over and hid her face,” the police report stated.

At this point, Jane Doe communicated with her parents who called the police and rushed over to the residence.

While investigating the incident, police officers spoke with a witness at the home who stated “… she saw Jacinto sit at the foot of the bed. She also claimed she saw him take photos of him and the girls on his phone. She said she saw him sit a beer down on the table next to the television so that he could touch Jane Doe,” the affidavit indicated.

Capuchin was arrested on Sept. 18 and charged with one count of indecency with a child by sexual contact, a second degree felony.

According to Section 12.33 of the Texas Penal Code, “An individual adjudged guilty of a felony of the second degree shall be punished by imprisonment in the institutional division for any term of not more than 20 years or less than two years. In addition to imprisonment, an individual adjudged guilty of a felony of the second degree may be punished by a fine not to exceed $10,000.”

Bond was set at $25,000 – which was posted – and Capuchin was released pending further legal proceedings.
